Acceptance of terms
By accessing or using keystonescaling.com (the “Site”), you agree to these Terms of Service (the “Terms”). If you do not agree, you should not use the Site. That's it — nothing buried, nothing clever.
These Terms apply to every visitor of the Site. A separate Privacy Policy covers how we handle information. If you become a client, your engagement will be governed by a written service agreement that supersedes these Terms for anything related to that work.
Description of services
Keystone Scaling Co provides patient acquisition services for independent medical practices. Our work typically includes:
- Paid advertising management on Facebook, Instagram, and Google Ads
- Lead-generation campaigns built around real case value
- AI-powered lead follow-up and nurture automation
- CRM setup and ongoing management (GoHighLevel)
- Appointment booking and calendar integration
- Strategic growth planning and consulting for independent practice owners
The exact scope of a given engagement is defined in the signed service agreement for that engagement — not on this Site.
Use of the website
You may browse the Site, read our work, and book a discovery call through the form provided. Form submissions are subject to our Privacy Policy.
- There are no user accounts on the public website — nothing to sign in to
- Nothing is sold, purchased, or transacted directly through the Site itself
- All commercial activity happens after a direct conversation and a signed agreement
Client relationships and service agreements
If you become a Keystone client, your engagement is governed by a separate, written service agreement that we both sign. That agreement defines scope, fees, timelines, deliverables, performance guarantees (where applicable), and termination terms.
These Terms cover the Site only. They do not create a service engagement by themselves and are not a substitute for the service agreement.
Disclaimers and no guarantees
We work hard to produce outcomes for our clients, and we put written performance terms into the agreements where it makes sense. On this Site, however, the following applies:
- No guarantee of specific business results. Lead volume, consult volume, conversion rates, and revenue are influenced by factors outside our control — including local market conditions, the practice's own operations, and ad platform dynamics.
- Past performance doesn't predict future results. Case studies and testimonials describe specific experiences with specific clients. They're real but they're not a forecast for yours.
- We are not medical professionals. Nothing we publish is medical advice. Clinical decisions, medical claims, and patient care are solely the practice's responsibility.
- Regulatory compliance is on the client. HIPAA, state medical advertising rules, and any other applicable regulations remain the client's responsibility. We design systems that are aware of these constraints, but we are not the client's compliance officer.
- We do not handle Protected Health Information (PHI). Our systems are not HIPAA BAA-covered. Clients must not push PHI into the systems we manage.
Limitation of liability
To the fullest extent permitted by law:
- The Site and any services described on it are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied
- Keystone's aggregate liability for any claim arising out of or relating to the Site or a client engagement is capped at the total fees paid to Keystone during the three months preceding the claim
- We are not liable for indirect, incidental, consequential, exemplary, or lost-profit damages, even if advised of the possibility
- We are not liable for failures caused by events outside our reasonable control — force majeure events, platform outages, regulatory actions, or similar
Intellectual property
All content on the Site — including copy, design, illustrations, imagery, the Keystone wordmark, and the underlying code — is the property of Keystone Scaling Co or our licensors, protected by applicable copyright, trademark, and other laws.
You may not copy, reproduce, modify, or distribute any portion of the Site without our prior written consent. Deliverables produced for clients are governed by the service agreement, which handles ownership, licensing, and usage rights explicitly.
Prohibited uses
In using the Site, you agree not to:
- Scrape, crawl, or otherwise use automated tools to access the Site (outside standard search engine indexing)
- Reverse-engineer, decompile, or attempt to derive source from the Site
- Use the Site or any of its content for competitive analysis intended to clone our approach
- Submit fraudulent form data, impersonate another person, or use the Site to distribute malicious content
- Interfere with the Site's security features or attempt to gain unauthorized access to any system
Termination
We may refuse service, block access, or terminate your use of the Site at any time and for any reason, particularly if we reasonably believe you've violated these Terms. Active client engagements terminate according to the service agreement — not these Terms.
Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law principles.
- The parties will first attempt to resolve any dispute through good-faith negotiation
- Unresolved disputes will be submitted to binding arbitration in New York County, New York, administered under the rules of the American Arbitration Association
- You agree that any dispute will be resolved on an individual basis. No class actions, collective arbitrations, or representative actions.
Changes to these terms
We may update these Terms as the business evolves. The updated Terms will be posted on this page with a new effective date. Continuing to use the Site after a change means you accept the updated Terms.
